Buying land for development

When our development clients have found a plot of land for their residential project, we ask them to contact us as soon as possible so that we can discuss and advise on the terms and challenges which may lie ahead.   

If you are considering a purchase of land for development, then we are happy to carry out some initial checks which will help you and may save some time.  So, for example we can see whether the land is registered or unregistered; look at the title of the land, if registered and advise whether the title contains any restrictive covenants which may restrict any new development; establish whether the land is subject to any existing options which allow a third party to buy the land; consider if the parcel is subject to any overage clauses which mean a payment could be due to a previous owner.  We are also happy to check the physical boundaries of the site against the title boundaries just to make sure there are no anomalies.

Buying land subject to planning permission

Many of our clients find a parcel of land which does not have the benefit of any planning permission to allow for a new development.

A client in this position, will not want to spend thousands of pounds submitting a planning application only to find, if granted, that the seller looks to re-negotiate the price – or worse still – sell the land to a third party.

In this situation, we support our clients by negotiating a conditional contract.  This can be a complex process which requires time and attention to detail.

Buying land with the benefit of planning permission

In some circumstances, our clients acquire land which already has the benefit of planning permission.  The land could be subject to an existing Section 106 Agreement which the developer will be expected to adhere to.  A Section 106 Agreement is likely to impose a financial obligation or may contain restrictions – for example, if the new homes are subject to age restrictions or are to be sold as social or affordable homes.
