What is the new Pathfinder route in children proceedings and how will it affect you?

The Pathfinder process was introduced across the Midlands, including Stoke-on-Trent, in November 2025 as the Family Court's new approach to private law children proceedings.

The aim is to improve the experience of children and families by placing the child at the centre of every decision. It also seeks to identify safeguarding concerns at an early stage, reduce conflict between parents, and help the court make informed decisions more efficiently.

How is the Pathfinder process different?

Under the previous process, the court would often hold an initial hearing before all the relevant information had been gathered, which could lead to further reports, additional hearings and delays.

The Pathfinder approach focuses on gathering key information before the first hearing, allowing the court to have a clearer understanding of the family's circumstances from the outset.

What happens if your case follows the Pathfinder route?

Once your application has been issued, Cafcass (or the local authority where appropriate) will carry out enhanced safeguarding enquiries. This may include speaking with both parents, carrying out police and local authority checks, and, where appropriate, speaking with the child. The information gathered is used to prepare a Child Impact Report, which helps the court understand the child's circumstances and any welfare concerns before the first hearing.

What does this mean for you?

The Pathfinder process aims to help cases progress more efficiently by ensuring the court has more information at an earlier stage. The purpose of this is to try to reduce delays; limit the number of court hearings; reduce conflict for families; and keep the focus on the child's welfare.

However, every case is different. Some matters will still require further investigations or additional hearings before a final decision can be made.
