What is Mediation?

Mediation is a process that helps you resolve your legal disputes co-operatively and effectively.

  • In the last 20 years mediation has grown to the extent that it is now seen as the Appropriate Dispute Resolution process in many, if not most, legal disputes. Most Court disputes now incorporate incentives and sanctions to encourage mediation.
  • Since April 2011, any individual seeking to start a court application dealing with children or financial matters is effectively required to attend a Mediation Information and Assessment Meeting before so doing, unless one of a small number of exceptions applies. Failure to do this is likely to lead to the strong disapproval of the Judge, the adjournment of any court process and the waste of any court or legal fees already incurred.
  • Typically, the parties to the dispute sit down together with an impartial third party in a confidential setting – in civil disputes, usually with the support of their lawyers
